On 26 January 2024, The International Court of Justice (ICJ) issued a ruling ordering Israel to take all possible measures to prevent genocidal acts against Palestinians in Gaza and to prevent and punish direct and public incitement to genocide. The ruling also ordered Israel to take immediate and effective steps to ensure the provision of basic services and humanitarian aid, to preserve evidence of genocide, and to submit a report to the ICJ. The ICJ's decision cited the comments of three senior Israeli officials in relation to the incitement to genocide. Israel must comply with the ICJ's ruling immediately, and all states must signal their respect for the Court's legally binding decision. The ICJ's provisional measures indicate that in the Court's view, there is a plausible risk of genocide being committed by the State of Israel.
However, the ICJ decision alone cannot put an end to the atrocities and devastation Gazans are witnessing. An immediate ceasefire by all parties remains essential. The ICJ's decisions are final and without appeal, but the court has no way to enforce them.
